The Federal Government realized they have a different relationship with Tribal Governments, which allowed for the creation of the Enhanced Tribal Card Program.
REAL ID Act applies to state-issued documents only. Tribal Nations are sovereign territories. The REAL Act established minimum security standards for state-issued driver’s licenses and identification cards and prohibits Federal agencies from accepting for official purposes licenses and identification cards from states that do not meet these standards.
The ETC falls under the Western Hemisphere Travel Initiative (WHTI) that requires all travelers to show a valid passport or other approved secure document when traveling to the U.S. from areas within the Western Hemisphere.
The ETC is not a state-issued document and therefore would NOT fall under REAL ID Act. Again, REAL ID Act applies to state issued documents only!
